criteria
If your case involves any of the following types of proceedings, but you cannot afford a lawyer and cannot obtain public funding (legal aid), then PILARS may be able to help you:
- applications to set aside statutory demands
- creditors’ bankruptcy proceedings
- applications to annul bankruptcy orders
- appeals of the above
The aim of the scheme is to help those who really need it. Accordingly, we do have eligibility criteria. PILARS will not accept a case unless the involvement of a barrister will be of real assistance to the client and there is a prospect that injustice might otherwise result. In addition, cases will not be suitable for PILARS in the following circumstances:
- If the client is represented by a firm of solicitors on a private or conditional fee basis or is entitled to public funding
- If the case involves unduly complex issues of law
- If a hearing has been listed and the hearing is due to take place in less than 48 hours.
